Open-access ¿Puede el perito forense negarse a realizar su labor?

When we consider that the Constitutional Tribunal of Costa Rica declared that the defendant can become "object of prove", it opened the way to collect different prove elements even without the defendant's permission, without it being considered an offense to the acuse's rights. Given that the accused or his attorneys can not legally deny for test to be done, the forensic experts are now the ones that refuse to do blood tests, take samples of hair, saliva, etc. , or to do any type of exams at all, which is a direct violation to the penal law by these professionals.
