Through the years the demands for mal praxis against Nursery Professionals and their Employers, has increased. This has been happen too In Costa Rica. The evaluations in demands of professional nursery responsibility are made by forensic doctors of the Legal Medicine Department of the Judicial Investigative Bureau (OIJ), when investigate damage or death. The Nurse Professional has to have the following minimal cares to the patient: optimum, opportune and continuous attention, careful attention, strict following of treatment and instructions from the doctor, written consensus from the patient previous explanation of the risky procedures. Many reasons have been invocated to demand a professional for mal praxis, but the majority do not correspond to unsanitary acts like: negligent, imprudence, or inexperience. We need to be conscious as professionals, to make better nursery reports, because these are elements which can be of help in the judicial proceed investigation.
